User Agreement and Acceptance of "Apple License Agreement".

Maksym Blazhivskiy (hereinafter referred to as the "Company") grants you access to the Website, its features, services, and applications subject to the terms set forth in this User Agreement. We kindly ask you to carefully read this Agreement, which constitutes a public offer from the Company.

1. Definitions.

1.1. User Agreement ("Agreement") refers to the text of this document along with all attachments, modifications, and additions posted in the distribution package or on the Company's website on the Internet.

1.2. Company - Maksym Blazhivskiy, a legal entity registered in accordance with the legislation of Ukraine at the address: Ukraine, Dnipro, Velyka Diyivsʹka 32.

1.3. Website - an informational portal, a computer program accessible through an information and telecommunications network, located at: https://cvhub.app.

1.4. Applications (or Application) - computer programs designed for smartphones, tablets, and other computer devices operating on various operating systems. Together, the Website and the Application are referred to as the "Products."

1.5. User - an individual who enters into this Agreement with the Company on their own behalf or on behalf of third parties in accordance with the requirements of applicable law and this Agreement.

1.6. App Store - a section of an online store containing various applications for mobile phones, players, tablets, and other computer devices, allowing the purchase or free download of these applications.

By accepting this Agreement, the User also confirms their acceptance of the "Apple License Agreement," available at Apple License Agreement.

2. General Provisions.

2.1. According to this Agreement, the Company grants the User the right to use the Products on the basis of a non-exclusive (simple) license.

2.2. Unless otherwise specified, the license to use granted by this Agreement is free of charge.

2.3. The Company provides the User with a non-transferable right to use the Products worldwide, subject to the following conditions:

2.3.1. Use of Applications according to their intended purpose. Copying and installation (reproduction) of Applications on User's mobile devices. The User has the right to install Applications on an unlimited number of devices.

2.3.2. Reproduction and distribution of the Products for personal non-commercial purposes.

2.4. This Agreement constitutes a public offer for the License Agreement. Acceptance of this Agreement is implied by performing the following actions:

2.4.1. Copying (installation) of Applications by the User on their device.

2.4.2. Actual use of the Products without copying (installation) to the extent and in the form available without copying (installation).

2.5. Acceptance of this Agreement implies the User's full and unconditional agreement to all its terms. By using the Products, the User also confirms their agreement with the Privacy Policy posted on the Website at https://privacy.cvhub.app. The use of the Products and their functionality is permitted solely on the terms of this Agreement.

2.6. By accepting this Agreement, the User confirms their legal status and capacity and acknowledges the accuracy of the provided information, assuming full responsibility for its accuracy, completeness, and reliability.

2.7. By accepting this Agreement, individuals consent to the processing of their personal data voluntarily provided by the Company. The Company processes the User's personal data for the purpose of fulfilling this Agreement, as well as for providing the User with personalized (targeted) advertising, verification, data research, and analysis to maintain and improve the services and sections of the Website, as well as to develop new services and sections of the Products. The Company takes all necessary measures to protect the User's personal data from unauthorized access, alteration, disclosure, or destruction. The Company provides access to the User's personal data only to employees, contractors, and agents who need this information to ensure the functioning of the Website and provide services to the User. The Company has the right to use the information provided by the User, including personal data, to comply with the requirements of applicable law (including the prevention and/or suppression of illegal actions by Users). Disclosure of information provided by the User may only be made in accordance with applicable law at the request of a court, law enforcement authorities, and in other cases provided by law.

2.8. The Company offers Users its Products on the terms set forth in this Agreement. The Company may amend the Agreement without prior notice. The new version of the Agreement comes into effect from the moment of its posting on the Website unless the new version of the Agreement provides otherwise. The current version of the Agreement is always available on the page https://tos.cvhub.app.

3. Restrictions on Proper Use.

3.1. The User is obligated to strictly comply with the terms of this Agreement.

3.2. The User has the right to use the Products solely for personal non-commercial purposes in accordance with the terms of this Agreement.

3.3. The User may not:

3.3.1. Use the Products in violation of the rights and lawful interests of rights holders, third parties, this Agreement, and applicable laws.

3.3.2. Reproduce, distribute, or process elements of the Products that are subject to copyright of the Company or third parties without prior permission from the respective rights holders, for commercial or non-commercial purposes.

4. Rights and Obligations of the Company.

4.1. The Company has the right to transfer the performance of this Agreement to third parties without additional consent from the User.

4.2. The Company has the right to provide Users with paid and free Products. Information about the terms of use of the Company's Products (program name, cost, payment form and procedure) is available in application stores. The terms of use are governed by the Company's terms and conditions.

4.3. The Company has the right to block User's access to the Products in case of User's violation of the obligations provided in this Agreement.

4.4. The Company has the right to restrict access to the functionality of the Products for organizational or technical reasons unilaterally until such reasons are resolved. The Company undertakes to resolve any issues with the functioning of the Products as soon as possible and notify the User by any available means if feasible.

4.5. The Company has the right to collect, store, and process statistical information about the User's use of the Products for the purpose of improving and enhancing the stability of the Products.

5. Limitation of Liability.

5.1. All Products are provided "as is," and the Company shall not be liable for any delays, interruptions, incorrect or timely delivery, deletion, or accidental destruction of any personal information of the User.

5.2. The Products may contain links to other resources. The User agrees that the Company is not responsible for the availability and content of these resources, as well as for any consequences related to the use of the content of these resources.

6. Intellectual Property Rights and Equivalent Objects.

6.1. The User acknowledges and agrees that the Products and programs associated with them are protected by laws on intellectual property, other laws, and international legal acts, and the content provided in the process of using the Products is protected by copyright. Except as expressly agreed by the Company, the User may not modify, sell, distribute, or use such content and programs, in whole or in part, without prior permission.

6.2. The Company grants the User a personal, non-exclusive, and non-transferable right to use the Products, provided that neither the User nor any other persons using it will copy or modify the Products; create derivative programs based on the Products; hack software to obtain the code of the Products; sell, transfer, lease, or otherwise transfer the rights to the Products provided to the User under this Agreement to third parties; or hack or gain unauthorized access to the Products.

7. Confidentiality.

7.1. The terms of confidentiality for information received by the Company from Users and the rules for processing Users' personal data are available at: https://privacy.cvhub.app.
